How to Use Technology and Obtain Electronic Data to Enhance Gang Investigations

This course is for Prosecutors and Law Enforcement and will address issues including identifying individuals who create and post materials on Web sites, retrieving data from cell phones and unopened emails, creating "shadow accounts" where duplicates of sent emails go directly to law enforcement, how to obtain "associational" evidence from computers to assist in establishing gang affiliation, how to expedite obtaining authority to initiate a wiretap, the "necessity" requirement for obtaining a wiretap, the required showing to obtain "roving, spin-off and extensions for" wiretaps, statutory responsibilities to the court when a wiretap is active and upon its conclusion, and how to access technical and informational assistance, as well as equipment that can be used to enhance gang investigations.

Overview of Hispanic Gangs and Recommended Investigative Techniques to Combat Their Criminal Activities

This panel discussion is for prosecutors and law enforcement and will include how Hispanic gangs organize and operate in the US, how to accurately identify Hispanic gang members and their cliques, how the culture and history of Hispanic gangs influences the mentalities of individual members and distinguishes their criminal objectives from gangs of other ethnicities, why Central America has a perversive effect on individuals who reside there and subsequently become gang members in the US, and recommended investigative techniques to employ in an effort to dismantle Hispanic gangs.

Session: 90 minutes
Panelists include representatives from both the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Federal Bureau of Investigation.

How Gang Intelligence Units in Federal and State Correctional Facilities Can Assist in Gang Suppression

This panel discussion is for prosecutors and law enforcement and will include how the Bureau of Prisons and the Connecticut Department of Corrections (as a state model) Gang Intelligence Units can assist in gathering and sharing intelligence regarding detained gang members, gang members as they're released from custody, providing investigative support such as monitoring mail, visitors and telephone calls, initiating special monitoring of or sequestering gang members, as well as a discussion involving the vital role such prison gang units have played in the successful prosecutions of violent gang members.

Public Housing Gang Suppression and Deterrence Strategies

This panel discussion is for prosecutors and law enforcement and will include innovative investigative techniques to combat gangs who engage in their criminal activities from public housing complexes, investigative strategies to eliminate the establishment and reduce the proliferation of gang-related activities in public housing complexes, resources HUD can provide to support and assist in deterrence and enforcement initiatives, and a case study focused on the techniques utilized during a recent investigation of a violent Chicago street gang, the Black Disciples, that operated in a public housing complex, which resulted in the prosecution of approximately 40 of its members by the United States Attorney's Office in the Northern District of Chicago.

Session: 1 hour
Panelists include representatives from HUD, a local police department, and the Department of Justice.

How to Attack a Violent Street Gang

This panel discussion is intended for prosecutors and law enforcement and includes recommended law enforcement tools needed to incapacitate a street gang, recognizing the type of individuals street gangs prey upon and why, how to send messages to street gangs that their criminal objectives and concurrent acts of violence will no longer be tolerated, why a neighborhood can't be completely "taken back" without establishing trust between members of the embattled community and law enforcement, and the advantages and recommended techniques to develop rapports with gang members.

Prosecuting Gangs Under an Enterprise or Conspiracy Theory

This panel discussion is for prosecutors and law enforcement and will include an overview of the RICO and VICAR statutes, how each statute can complement the other or stand alone, how to develop an investigation that will meet the evidentiary requirements for an Enterprise theory of liability, evidence to consider when making charging decisions, and the advantages and disadvantages of charging a RICO versus a Conspiracy case.

Identifying Gun and Drug Trafficking Corridors

This panel discussion is for prosecutors and law enforcement and includes identifying the multiple domestic passageways from where crime guns and controlled substances are trafficked and the domestic locations where each are ultimately distributed or sold, why law enforcement and prosecutors should have an interest in crimes that originate in their jurisdiction when the overt acts occur in other jurisdictions, and what information-sharing models can be utilized to shut down trafficking organizations through interdistrict cooperation.

Enforcement Strategies to Comprehensively Address Multiple Gang Threats

This panel discussion is for prosecutors and law enforcement and includes initiating multi-agency gang investigations, overcoming territorial disputes and resource issues, effectively utilizing all available resources in developing a comprehensive anti-gang enforcement strategy, identifying and pairing law enforcement agencies that are best equipped to attack a specific gang problem, and coordination and information sharing among law enforcement agencies.

The Clarksdale Story: How Law Enforcement Responded When Gangs Saturated a Small Community in Mississippi with Drug Trafficking and Gun Violence

This panel discussion for prosecutors and law enforcement will include the multiple tools used by law enforcement and the local United States Attorney's Office to simultaneously attack multiple violent gangs, how limited resources were marshaled and investigations were efficiently undertaken to abruptly reduce incidents of violence, how aggressive prosecutions and securing the cooperation of community leaders were vital in the gang suppression efforts, and how a weak, ineffective, and failing police department evolved into one that became a strong, mature, robust agency which played a major role in restoring order in Clarksdale.

Gang Deterrence Strategies for Juveniles

This panel discussion is for prosecutors and law enforcement and includes an innovative initiative where law enforcement, community leaders, mediation groups and others intervene when juveniles are identified as being members of gangs or have gang affiliations, by confronting these juveniles, along with their parents or guardians, about the consequences of their choices and offering numerous programs and services to assist them in establishing legitimate lifestyles. The panel discussion will also involve an enormously successful initiative where juveniles and young adults identified as being "at risk" competed in a contest that involved recording a rap song with an anti-gang or anti-gun violence message that resulted in the 10 winners recording their songs in a professional studio onto a compact disk that will be played by radio stations, heard on television, distributed in schools and to community members in an effort to disabuse at-risk juveniles of the notion that a gangster lifestyle is glamorous or seductive.

Gang Intervention Initiatives for Adults

This panel is for prosecutors and law enforcement and will include initiatives that can effectively reduce recidivism and prevent individuals resuming gang affiliation after disposition or upon re-entry by methods that include gang members who, are under the authority of the court, are "flagged" by the probation department and are required to comply with special terms and conditions, all which renounce gang membership and must participate in special programs designed to undermine the appeal of a gang-related lifestyle and which present the individual with viable alternatives. Further, the panel will address an initiative that involves, in part, individuals who commit federal crimes, depending on criminal history, an opportunity to stop committing crime, to immediately begin participating in rehabilitative programs, and establish a legitimate lifestyle in exchange for the local United States Attorney's Office agreeing not to charge them with the federal offense.

Prosecuting a Juvenile in the Federal System

Juveniles are not routinely pursued on federal charges and the statutory provisions governing such procedures can be challenging. This breakout will provide federal prosecutors with an overview of the procedural steps from arrest to adult conviction. The circumstances under which an adult conviction is even possible will also be explained. In addition, issues surrounding interrogation, booking, rights particular to juveniles, and the housing of juveniles will also be discussed.
